Terms and Conditions - Sales to UK Customers 16/11/2020

  1. Delivery: Free three day delivery on UK mainland. (Please call for details of charges for highlands and islands, offshore UK and export.) Next working day delivery upgrade attracts a £7.00 charge. Deliveries of cabinets are not offered with free delivery but are subject to a charge which covers our cost (details on application) unless we have specific agreement to the contrary.
     
  2. Orders received by 1p.m. will generally be processed on the same day unless the customer specifically requests a delayed dispatch.
     
  3. Small Orders:
    – A minimum invoice value applies for any order intended for delivery on its own. For goods delivered to or collected by an account customer the minimum is £50. For Trade Counter customers the minimum is £25
    – A handling charge (which includes delivery) of £13 applies to all consignments costing less than £250 (excluding VAT)
     
     
  4. All products are offered subject to availability.
     
  5. Any discrepancy with a delivery must be notified by the later of 5 working days from despatch or 48 hours after delivery.
     
  6. The liability of TUK Ltd is limited to the value of the goods supplied and TUK Ltd shall in no circumstances be liable for any consequential loss or loss of profits.
     
  7. Whilst every effort is made to ensure the accuracy of descriptions given, TUK Ltd reserves the right to make any changes to the design, specifications, materials, finishes or methods of manufacture from time to time. All forms of description (samples, drawings, specifications, advertising and photos or descriptions in TUK’s promotional materials or the relevant websites) are published for the sole purpose of giving an approximate idea of the goods shown or described. No liability is accepted for any variation unless there is a specific and separate written agreement for sale by sample.
     
  8. All prices exclude VAT. We aim to maintain prices for a reasonable time but reserve the right to alter prices at any time.
     
  9. All goods remain the property of TUK Ltd until the relevant invoice is paid in full.
     
  10. If goods and/or services are delivered/completed in instalments TUK Ltd shall be entitled to invoice for each instalment as and when each instalment is delivered/completed and payment shall be due in respect of each instalment delivered/completed notwithstanding non-delivery/non-completion of other instalments or other default by TUK Limited.
     
  11. All goods must be paid for prior to dispatch or collection unless a customer has an account with TUK Ltd. The following payment methods are accepted:
    -Cleared or guaranteed cheque.
    -Cash: up to £100
    -Debit card: up to a value of £1000 + VAT
    -Bank transfer – please contact us for details
     
  12. Exports: Separate terms and conditions apply to export sales; please call for details.
     
  13. TUK Ltd has taken reasonable steps to ensure that goods supplied do not breach patent, copyright or other intellectual property rights but no guarantee in this respect is given and no liability accepted. The TUK logo is trademarked; the TUK Ltd website, price lists and all images in them are copyright of TUK Ltd and none of these (part or whole) may be copied or used without the specific written consent of TUK Ltd.
     
  14. TUK Ltd will deliver to the customers main warehouse address as standard. If, on request by a customer, TUK Ltd agrees to deliver to a customer’s customer or to a worksite, TUK Ltd accepts no liability for loss or damage in circumstances where TUK Ltd can produce a proof of delivery to the address given by the customer.
     
  15. Accounts: To open an account please ask for our account application form. Account applications are normally authorised within 10 working days.
     
  16. Upon dealing with TUK Ltd you acknowledge that we have a legitimate interest in retaining information which enables us to identify and communicate with you and relevant individuals in your organisation and that we shall do so for at least 2 years after our last significant interaction.
     
  17. Our T&C’s are updated from time to time. For the most up to date version.
     
  18. All sales and account facilities are subject to English law and any dispute is to be resolved in the court in London, England.

Terms and Conditions - Sales to Overseas Customers 16/06/2021

  1. Prices quoted are EXW-Incoterms 2010. Delivery and insurance can be arranged on behalf of the customer and will be at cost plus a small handling charge.
     
  2. (For the Netherlands and Ireland only – Prices quoted are DDP per Incoterms 2020. Delivery charges are stated before goods are sent and invoices are raised indicating VAT payable.)
     
  3. All products are offered subject to availability.

  5. All goods must be paid for prior to dispatch or collection unless a customer has an account with TUK Ltd. Please contact us for details for payment by bank transfer.
     
  6. Any discrepancy with a delivery must be notified to TUK Ltd by the later of 7 working days from despatch or 48 hours after delivery.

If the goods and/or services are delivered/completed in instalments TUK Ltd shall be entitled to invoice for each instalment as and when each instalment is delivered/completed and payment shall be due in respect of each instalment delivered/completed notwithstanding non-delivery/non-completion of other instalments or other default by TUK Ltd.
     
  12. Orders will be picked, packed and dispatched as soon as possible on receipt of written confirmation of the order and after acceptable arrangements have been made for payment.
     
  13. Environmental Policy: TUK Ltd has a positive recycling policy. Consequently, customers may receive goods in recycled outer packaging, subject to agreement to the contrary.
     
  14. TUK Ltd has taken reasonable steps to ensure that goods supplied do not breach patent, copyright or other intellectual property rights in the UK. TUK Ltd accepts no liability additional to liabilities which TUK would face with regard to a similar customer based in the UK. The customer must satisfy themselves as to the legal requirements in their own country/market.
     
  15. The TUK logo is trademarked; the TUK Ltd website, price lists and all images in them are copyright of TUK Ltd and none of these (part or whole) may be copied or used without the specific written consent of TUK Ltd.

TERMS AND CONDITIONS FOR CREDIT ACCOUNTS

  1. When applying for credit, in addition to accurately providing details of your own business, account applicants must provide 2 relevant trade references with telephone numbers and contact details.
     
  2. Payment terms are STRICTLY 30 DAYS. Account customers are expected to pay within 30 days without reminder unless alternative payment terms have been agreed with us in advance in writing.
     
  3. If payment is not made within the allowed credit period, all amounts outstanding become due immediately and all account facilities may be withdrawn without notice.
     
  4. Deliveries will be delayed or even stopped if there are any amounts overdue on account.
     
  5. TUK Ltd reserves the right to charge 1.5% per month interest on overdue payments.
     
  6. If any amount is overdue TUK is entitled without discussion to contra any amounts owed by TUK against such overdue amount.
     

PRIVACY POLICY

WHO WE ARE
TUK Ltd produces and supplies cabling systems and connectivity. This policy relates to all such activities including those of any group companies.
TYPES OF DATA WE PROCESS
  • General
    We hold data about our employees, our customers and suppliers. We hold the minimum necessary information for the shortest reasonable time. We do not pass such information onto 3rd parties unless we are obliged to. Such information is held on the grounds of legal obligation under contract or due to our legitimate interest in holding the data to fulfil legal or contractual obligations as an employer, supplier or customer.
     
  • Cookies
    Where possible we minimise the use of cookies on our websites. They are used to facilitate use of the website but we do not use them for marketing.
     
  • Website Analytics
    We use website analytics in anonymised form to learn how to improve the performance of our websites.
     
  • Mailing Lists
    We collect personal information about customers and prospective customers who have shown an interest in our products or services. We use that information to tell you about new and existing products and services. We don’t rent or trade email lists with other organisations and businesses
    Our email ‘shots’ are sent by us rather than by a third party. Anyone receiving an unwanted promotional email can be removed from our mailing list, although we shall continue to hold necessary data if they remain a customer.
     
  • Publicly Available Information
    If we hold personal information that is readily available in the public domain, we exercise the right not to delete it unless or until we are satisfied it is no longer useful, unless asked to do so by the data subject.
     
  • HOW WE USE DATA
    When you deal with TUK as a customer or supplier or employee, your name, company (if applicable), address data, email and contact telephone number will be stored by us, securely and for the minimum amount of time.
    TUK reviews our customer data base on a regular basis and contacts customers every 2 years to confirm that they are happy to continue receiving e-mails relating to special offers and products (whether launches or reminders).
     
  • TUK uses customer’s personal data:
    -to provide goods and services;
    -to provide relevant and useful information/promotions
    -to manage any registered account(s) held with us;
    -to verify identity;
    -for crime and fraud prevention, detection and related purposes;
    -for market research purposes – to better understand customer needs;
    -to enable us to manage customer service interactions; and
    -where we have a legal right or duty to use or disclose your information (for example in relation to an investigation by a public authority or in a legal dispute).
     
  • ACCESS TO YOUR PERSONAL INFORMATION
    Under GDPR, you are entitled to view, amend, and potentially delete the personal information that we hold. An access request may be subject to a fee of £10 to cover our administrative costs.
